Abstract
Secara umum Kekerasan Dalam Rumah Tangga (KDRT) adalah “Setiap perbuatan terhadap seseorang terutama perempuan, yang berakibat timbulnya kesengsaraan atau penderitaan secara fisik, seksual, psikologis dan/atau penelantaran rumah tangga termasuk ancaman untuk melakukan perbuatan, pemaksaan, atau perampasan kemerdekaan secara melawan hukum dalam lingkup keluarga”. Kekerasan Dalam Rumah Tangga (KDRT) disebut juga sebagai kekerasan domestik (domestic violence). Permasalahan yang dikaji dalam penelitian ini yaitu bagaimana cara penyelesaian hukum terkait tindak pidana kekerasan fisik dalam rumah tanggadan bagaimana efektivitas penyelesaian kasus di lingkungan keluarga yang melakukan tindak pidana kekerasan fisik di Pengadilan Negeri Kota Semarang. Metode pendekatan yang digunakan dalam penelitian ini adalah yuridis normatif, spesifikasi penelitian secara in concreto, sumber data sekunder, data yang diperoleh akan dianalisis secara kualitatif. Hasil penelitian dari penyelesaian hukum yang penulis teliti diselesaikan dengan hukum pidana. Pasal-pasal yang diterapkan oleh Jaksa Penuntut Umum dalam surat dakwaan, yaitu: dakwaan primer: Pasal 44 ayat (1) UU No. 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga tentang Penghapusan Kekerasan Dalam Rumah Tangga, dakwaan subsidair: dalam Putusan Nomor: 616/Pid.Sus/2017/PN. Smg: Pasal 44 Ayat (1) Jo Pasal 5 Huruf a Undang-Undang Nomor 23 Tahun 2004 Tentang Penghapusan Kekerasan DalamRumah Tangga, Pasal 351 Ayat (1) Kitab Undang-Undang Hukum Pidana tentang penganiayaan. In general, Domestic Violence (KDRT) is “Every act against someone, especially women, which results in physical, sexual, psychological and / or domestic misery or suffering, including threats to commit acts, coercion, or illegal deprivation of liberty. within the family circle”. Domestic Violence (KDRT) is also known as domestic violence. The problems examined in this study are how to resolve the law related to criminal acts of physical violence in the household and how to effectively resolve cases in families who commit physical violence in the Semarang City District Court. The approach method used in this research is normative juridical, in-concreto research specifications, secondary data sources, the data obtained will be analyzed qualitatively. The results of the research from the legal settlement that the author examined were completed by criminal law. The articles applied by the public prosecutor in the indictment are: primary indictment: Article 44 paragraph (1) of Law no. 23 of 2004 concerning the Elimination of Domestic Violence concerning the Elimination of Domestic Violence, subsidair charges: in Decision Number: 616 / Pid.Sus / 2017 / PN. Smg: Article 44 Paragraph (1) Jo Article 5 Letter a Law Number 23 Year 2004 Concerning the Elimination of Domestic Violence, Article 351 Paragraph (1) of the Criminal Code concerning persecution.
