Abstract
Perlindungan hukum bagi penjual atas pemblokiran sertifikat(sementara) dalam proses peralihak hak atas tanah di Kota Semarang.Adanya perlindungan bagi penjual atas blokir tanah merupakan langkah yang tepat untuk suatu penyelesaian sengketa,konflik tanah yang berada di kota Semarang. Tanah ialah karunia Allah SWT yang diberikan untuk umat nya di bumi tercinta. Tanah difungsikan oleh manusia sebagai kehidupan sehari hari misalnya perkebunan, pertanian, properti perumahan. Dengan penelitian atas judul tersebut maka tujuannya ialah memberikan pemahaman bagi msayrakat terkait blokir tanah. Harapan untuk peneliti untuk kasus sengketa tanah yang ada di kota Semarang agar dapat menurun. Metode penelitian dengan cara pendekatan,pencatatan,pendataan,studi pustaka,studi kasus dan analisa yang diambil oleh peniliti. Dengan mengumpulkan data primer dan sekunder ialah pengumpulan database terkait dengan blokir tanah di kota semarang, wawancara terhadap pihak pihak terkait serta pengumpulan kepustakaan dari UU,PP dan buku. Perlindungan hukum bagi penjual berdasarkan Permen ATR/BPN No. 13 Th. 2017 tentang “Blokir tanah dan sita” dan bantuan advokat.. ADR (Alternative Dipute Resolution) UU No.30 Th 1999. Yurisprudensi MA-RI No. 126 K/Sip/1962 jo. MA-RI No.1211K/Sip/1971 bahwa pembeli yang beritikad baik mendapatkan perlindungan hukum. Legal protection for sellers of (temporary) certificate blocking in the process of legal rights over land in Semarang City. The existence of protection for sellers of block land is the right step for a dispute resolution, land conflict in the city of Semarang. Land is a gift from Allah SWT which is given to his people on his beloved earth. Land is used by humans as daily life, for example plantations, agriculture, residential property. With research on this title, the aim is to provide an understanding for the community related to land blocking. The hope for researchers for land dispute cases in the city of Semarang will decrease. The research method used was an approach, recording, data collection, literature study, case studies and analysis taken by the researcher. By collecting primary and secondary data is the collection of databases related to land blocks in the city of Semarang, interviews with related parties and collection of literature from laws, government regulations and books. Legal protection for sellers based on Permen ATR / BPN No. 13 Th. 2017 concerning "Blocking land and confiscation" and advocates' assistance. ADR (Alternative Dipute Resolution) Law No.30 of 1999. Jurisprudence of the Supreme Court of the Republic of Indonesia No. 126 K / Sip / 1962 jo. MA-RI No.1211K / Sip / 1971 that buyers with good intentions get legal protection.
