Abstract

Anak adalah generasi penerus generasi bangsa, oleh karena itu sangat lumrah dan harus diperjuangkan hak-hak anak seutuhnya tanpa terkecuali, baik dari segi kebutuhan secara materiil maupun secara rohani, melindungi kehormatan anak sangatlah menjadi keharusan khususnya untuk anak perempuan, apabila kehormatan seorang anak terangkut, makaperkembangan anak tersebut bisa terganggu, karena masa lalunya yang tidak bisa terlupakan. Maraknya pemerkosaan yang terjadi di kota Semarang semakin tahun semakin meningkat, oleh sebab itu kejadian ini harus dihentikan dengan sanksi pidana yang membuat pelaku menjadi jera terhadap kasus perkosaan anak dibawah umur, rumusan masalah dari penelitian ini adalah apa dasar pertimbangan hakim dalam menjatuhkan putusan terhadap pelaku tindak pidana perkosaan di bawah umur di pengadilan negeri Semarang,?,dan apa tinjauan hukum atas dasar pertimbangan hakim dalam menjatuhkan putusan terhadap pelaku tindak pidana perkosaan an dibawah umur di pengadilan negeri Semarang? Penelitian ini menggunakan metode yuridis normatif, oleh karena itu penulis menggunakan data sekunder sebagai bahan penelitiannya yang terkait tindak pidana perkosaan anak dibawah umur,tujuan dari penelitian ini adalah untuk mengetahui dasar pertimbangan hakim dalam menjatuhkan putusan terhadap pelaku tindak pidana perkosaan di bawah umur dan mengetahui tinjauan hukum atas dasar pertimbangan hakim dalam menjatuhkan putusan tindak pidana pelaku perkosaan dibawah umur di pengadilan negeri Semarang. hasil dari penelitian ini dapat diketahui berdasarkan dua hal, yaitu dasar pertimbangan hakim dalam menjatuhkan putusan terhadap tindak pidana pelaku perkosaan di bawah umur yang didasarkan atas tiga aspek yaitu aspek fakta hukum, aspek yuridis dan aspek sosiologis sedangkan untuk tinjauan hukumnya hakim mempertimbangkan empat hal yaitu, tinjauan hukum atas dasar pertimbangan fakta hukum, tinjauan hukum atas dasar pertimbangan yuridis, tinjauan hukum atas dasar pertimbangan sosiologis dan tinjauan hukum atas dasar pertimbangan filosofis, dari penelitian ini dapat disimpulkan bahwa hakim mengambil keputusan berdasarkan tiga aspek dan 4 hal,ini dilakukan untuk mencapai keadilan sebagaimana yang tertuang dalam ideologi Pancasila sila kelima yaitu keadilan sosial bagi seluruh rakyat Indonesia. Children are the next generation of the nation's generation, therefore it is very commonplace and the full rights of children must be fought for without exception, both in terms of material and spiritual needs, protecting the honor of children is a must, especially for girls, if the honor of a child is carried away, then the development of the child can be disturbed, because of his unforgettable past. The rise of rape that occurs in the city of Semarang is increasing every year, therefore this incident must be stopped with criminal sanctions that make the perpetrator become deterrent to cases of rape of minors, the formulation of the problem of this research is what is the basis for the judge's consideration in making a verdict against the criminal underage rape in the Semarang district court, and what is the legal review based on the judge's consideration in verifying the perpetrator of the crime of underage rape in the Semarang district court? This study uses the normative juridical method, therefore the authors use secondary data as research material related to the crime of underage rape, the purpose of this study is to find out the basis for judges' considerations in making decisions against the perpetrators of underage rape and to know the reviews. law based on the judge's consideration in verifying the criminal act of underage rape in the Semarang district court. The results of this research can be seen based on two things, namely the basis for the judge's consideration in making a decision on the criminal act of underage rape based on three aspects, namely the legal, juridical and sociological aspects, while for the legal review the judge considers four things, namely, the review. law based on legal fact considerations, legal reviews based on juridical considerations, legal reviews based on sociological considerations and legal reviews based on philosophical considerations, from this research it can be concluded that judges make decisions based on three aspects and 4 things, this is done to achieve justice as which is contained in the fifth principle of Pancasila ideology, namely social justice for all Indonesian people.
