Abstract
Dalam rangka penegakan disiplin terhadap pelanggaran yang dilakukan oleh Taruna Akademi Kepolisian, diterbitkan Peraturan Kepala Lembaga Pendidikan dan Pelatihan Kepolisian Negara Republik Indonesia Nomor 1 Tahun 2018 Tentang Kode Kehormatan Peserta Didik Pada Akademi Kepolisian. Meskipun sudah ditetapkan Peraturan Kepala Lembaga Pendidikan Dan Pelatihan Kepolisian Negara Republik Indonesia Nomor 1 Tahun 2018 tentang Kode Kehormatan Peserta Didik pada Akademi Kepolisian masih ada Taruna Akademi Kepolisian yang melakukan pelanggaran disiplin. Permasalahan yang timbul adalah; Bagaimana peran URGAKPLIN ( urusan penegakan disiplin) dalam melakukan penegakan disiplin terhadap terhadap pelanggaran yang dilakukan oleh Taruna AKPOL? Bagaimana hambatan-hambatan URGAKPLIN dalam penegakkan disiplin terhadap pelanggaran yang dilakukan oleh Taruna AKPOL? Tipe penelitian yang digunakan dalam penelitian ini adalah yuridis normatif. Tujuan penelitian; Untuk menjelasakan peran URGAKPLIN ( urusan penegakan disiplin) dalam melakukan penegakan disiplin terhadap terhadap pelanggaran yang dilakukan oleh Taruna AKPOL.,untuk menjelaskan hambatan-hambatan URGAKPLIN dalam penegakkan disiplin terhadap pelanggaran yang dilakukan oleh Taruna AKPOL.Hasil penelitaian menunjukkan; peran urgakplin ( urusan penegakan disiplin) dalam melakukan penegakan disiplin terhadap terhadap pelanggaran yang dilakukan oleh taruna akpol: sebagai unsur pembinaan terhadap taruna untuk membentuk dan meningkatkan kedisiplinan para taruna, sebagai unsur penindakan terhadap pelanggaran yang dilakukan oleh taruna. Setiap taruna melakukan pelanggaran, urgakplin mengeluarkan LP (laporan Polisi) yang di teruskan ke Batalyon untuk ditindak lanjuti. Hambatan-hambatan URGAKPLIN dalam penegakkan disiplin terhadap pelanggaran yang dilakukan oleh Taruna AKPOL;kewenangan sangat terbata, Uurgakplin hanya berhak memeriksa taruna akpol, sedangkan apabila pelanggaran disiplin taruna melibatkan orang luar, harus meminta bantuan pemeriksaan dari ur provos, sehingga menghambat jalannya pemeriksaan. Kekurangan anggota, apabila taruna banyak yang melakukan pelanggaran, urgakplin tidak bisa dengan cepat menyelesaikan setiap berkas pelanggaran tersebut. Terkait dengan pedidikan yang dilakukan oleh AKPOL (Akademi Kepolisian) dan penegakkan disiplin terhadup Taruna AKPOL bukanlah suatu pelanggaran karena ada alasan penghapus pidana di luar KUHP. Alasan penghapus pidana tersebut adalah hak orang tua, guru untuk menertibkan anak-anak atau anak didiknya (tuchtrecht). In order to enforce discipline against violations committed by the Cadets of the Police Academy, a Regulation of the Head of the National Police Education and Training Institute of the Republic of Indonesia Number 1 of 2018 concerning the Code of Honor for Students at the Police Academy was issued. Even though the Regulation of the Head of the National Police Education and Training Institute of the Republic of Indonesia Number 1 of 2018 concerning the Code of Honor for Students at the Police Academy has been stipulated, there are still Police Academy Cadets who have committed disciplinary violations. The problems that arise are; What is the role of Disipline Enforcement Section in enforcing discipline against violations committed by AKPOL cadets? What are the Disipline Enforcement Section obstacles in enforcing discipline against violations committed by AKPOL cadets? The type of research used is normative juridical. Research purposes; To explain the role of Disipline Enforcement Section in enforcing discipline against violations committed by AKPOL cadets, to explain Disipline Enforcement Section obstacles in enforcing discipline against violations committed by AKPOL cadets. Research results show; the role of urgency (Disipline Enforcement Section) in enforcing discipline against violations committed by cadets of cadets: as an element of guidance for cadets to form and improve discipline for cadets, as an element of prosecution against violations committed by cadets. Every cadet commits a violation, Disipline Enforcement Section to issue an Police report which is forwarded to the Battalion for follow-up. Disipline Enforcement Section obstacles in enforcing discipline against violations committed by AKPOL cadets; the authority is very limited, Disipline Enforcement Section only has the right to examine AKPOL cadets, whereas if the disciplinary violation of cadets involves outsiders, they must ask for examination assistance from ur provos, thus obstructing the course of the examination. Lack of members, if many cadets commit violations, Disipline Enforcement Section cannot quickly complete each file of the violation. Regarding the education carried out by the AKPOL (Police Academy) and the enforcement of discipline against AKPOL cadets, it is not an offense because there are reasons for the removal of crimes outside the Criminal Code. The reason for eliminating the crime is the right of parents, teachers to discipline their children or students (tuchtrecht).
