Abstract
Ketertarikan terkait penelitian ini yaitu untuk mengetahui bentuk penetapan perkawinan wali adhal dan mengenai dasar pertimbangan hakim beserta akibat hukum yang timbul pada permasalahan tersebut, untuk itu penulis tertarik mengambil penelitian ini. Penelitian ini merupakan penelitian yuridis normatif, dengan cara menggunakan bahan penelitian dari data sekunder yang dikumpulkan melalui studi kepustakaan yang dilakukan dengan membaca literatur, jurnal, dan sumber-sumber lainnya yang relevan dan berhubungan langsung dengan objek penelitian, selain itu penulis juga melakukan penelitian lapangan yang dilakukan dengan cara wawancara terhadap panitera yang ada di Pengadilan Agama Demak. Hasil yang diperoleh dari penelitian ini yaitu bentuk perkawinan dengan cara wali adhal pada perempuan sendiri dapat dilaksanakan seperti pernikahan pada umumnya jika sudah mendapatkan putusan dari Pengadilan Agama dan wali hakim juga sudah ditentukan, dasar pertimbangan hakim memberikan putusan kepada wali adhal yaitu karena tidak ada alasan yang bertentangan dengan Peraturan Perundang-Undangan yaitu dalam UndangUndang No. 1 Tahun 1974 dan Kompilasi Hukum Islam. Interest related to this research is to find out the form of marriage wali adhal and regarding the basis of the judge`s considerations, along with the legal consequences that arise in these problems, for that the author is interested in taking this research. This research is a normative juridical research, by using research materials from secondary data collected through library research conducted by reading literature, journals, and other relevant sources and is directly related to the object of research, besides that the author also conducts field research which conducted by interviewing the clerk in the Demak Religious Court. The results of this study are that the form of marriage by means of wali adhal on women themselves can be carried out like general if it has received a decision from the Religious Court and the wali of the judge has also been determined, and the basis for consideration of the judge gives a decision to wali adhal, because of there is no reason that contrary to the Laws and Regulations, That is in Law No. 1 of 1974 and the Compilation of Islamic Law.
