Abstract
Subdirektorat Barang Bukti (Subdit-Barbuk) Dittahti Polda Jateng bertanggung jawab dalam melakukan pengelolaan barang bukti sitaan. Pengelolaan barang bukti adalah tata cara atau proses penerimaan, penyimpanan, pengamanan, perawatan, pengeluaran dan pemusnahan benda sitaan dari ruang atau ke tempat khusus penyimpanan barang bukti. Petugas harus mencegah terjadinya risiko terhadap barang bukti sitaan dan bertanggung jawab apabila terjadi risiko seperti susut, busuk, rusak, hilang dan sebagainya. Tujuan yang hendak dicapai dalam penelitian ini adalah untuk menjelaskan tanggung jawab Subdit Barbuk Dittahti Polda Jateng terhadap hilangnya barang bukti sitaan dan akibat hukum hilangnya barang bukti sitaan oleh Subdit Barbuk Dittahti Polda Jateng. Penelitian ini menggunakan tipe penelitian yuridis empiris. Penulisan skripsi ini menggunakan sumber data primer dan sekunder. Metode analisa data yang dipergunakan dalam penelitian ini adalah metode kualitatif. Hasil penelitian menemukan bahwa tanggung jawab Subdit Barbuk Dittahti Polda Jateng terhadap hilangnya barang bukti sitaan adalah tanggung jawab administrasi dan tanggung jawab fisik sedangkan tanggung jawab yuridis tetap dibebankan pada Penyidik. Subdit Barbuk Dittahti Polda Jateng bertanggung jawab terhadap barang bukti yang sudah dititipkan oleh penyidik dan Subdit Barbuk melakukan pengelolaan barang bukti dengan cara merawat, menjaga supaya nilai ekonomisnya tidak berkurang dan menginventaris barang bukti dan melaporkan secara berjenjang. Akibat hukum hilangnya barang bukti sitaan oleh Subdit Barbuk Dittahti Polda Jateng adalah adanya pemberian sanksi terhadap Dittahti yang lalai sesuai dengan peraturan perundang-undangan dan ditentukan berdasarkan hasil penyelidikan di lapangan. Subdit Barbuk Dittahti Polda Jateng akan menurunkan tim untuk menyelidiki penyebab hilangnya barang bukti dan kemudian mengambil langkah-langkah berikutnya sesuai dengan hasil penyelidikan dan Perkap Nomor 8 Tahun 2014. The Sub-Directorate of Evidence (Sub-Directorate-Barbuk) of the Central Java Regional Police Directorate is responsible for managing confiscated evidence. Management of evidence is the procedure or process of receiving, storing, securing, maintaining, releasing and destroying confiscated objects from a room or to a special place for storing evidence. The officer must prevent the risk of confiscated evidence and be responsible if there is a risk such as shrinkage, rot, damage, loss and so on. The aim of this research is to explain the responsibility of the Sub-Directorate of Barbuk Dittahti of the Central Java Regional Police for the loss of confiscated evidence and the legal consequences of the loss of confiscated evidence by the Central Java Police's Barbuk Dittahti Sub-Directorate. This study uses the type of empirical juridical research. The writing of this thesis uses primary and secondary data sources. The data analysis method used in this research is a qualitative method. The results of the study found that the responsibility of the Central Java Police for the loss of confiscated evidence was administrative responsibility and physical responsibility, while the juridical responsibility remained with the investigators. The Sub-Directorate of Barbuk Dittahti of the Central Java Police is responsible for the evidence that has been deposited by investigators and the Sub-Directorate of Barbuk manages the evidence by taking care of it, keeping its economic value from decreasing, and taking an inventory of the evidence and reporting in stages. The legal consequence of the loss of confiscated evidence by the Sub-Directorate of Barbuk Dittahti of the Central Java Police is the imposition of sanctions on the Dittahti who is negligent in accordance with the legislation and is determined based on the results of field investigations. The Sub-Directorate of Barbuk Dittahti of the Central Java Police will send a team to investigate the cause of the loss of evidence and then take the next steps in accordance with the results of the investigation and Perkap Number 8 of 2014.
