Abstract

Perbedaan Roya Elektronik dengan manual adalah berkas dari pemohon discan dan didaftarkan melalui website dan langsung dikoreksi oleh pelaksana roya, tidak melalui loket pertanahan. Sehingga Notaris/PPAT tidak harus datang ke Kantor Pertanahan karena dapat di onlinekan dari kantor Notaris. Setelah diroya sertipikat hak atas tanah kemudian diberikan kembali kepada pemenanf lelang. Dalam Prakteknya dipedesaan pemenang lelang yang telah melunasi hutangnya pada Bank dan mendapatkan surat roya, tetapi pada sertipikat hak atas tanahnya masih memuat catatan barcode pembebanan Hak Tanggungan Elektronik walaupun kenyataanya tanah sudah bersih dari beban. Berangkat hal tersebut maka penulis timbul dua pertanyaan : Bagaimana Pelaksanaan Penghapusan Roya Hak Tanggungan Secara Elektronik di Kantor Pertanahan Kabupaten Batang? Dan Apa sajakah Faktor Penghambat dan Pendukung dalam Pelaksanaan Penghapusan Roya Hak Tanggungan Secara Elektronik di Kantor Pertanahan Kabupaten Batang?. Metode penelitian yang akan digunakan dalam penulisan ini adalah metode penelitian yuridis normatif. Pelaksanaan penghapusann roya dengan Sistem HT-el di Kantor Pertanahan Kota Batang belum semua dilakukan sesuai dengan prosedur yang tertera pada Juknis HT-el. Berkas-berkas permohonan yang tidak sesuai prosedur diketahui atas hasil dari pemeriksaan Kantor Pertanahan, jika tidak diperiksa Sertipikat HT-el akan terbit dengan sendirinya pada hari ke tujuh. Hambatan dalam pendaftaran HT dengan Sistem HT-el terjadi pada PPAT, Bank sebagai kreditor dan Kantor Pertanahan. Hambatan ini muncul pada saat proses pendaftaran HT baik secara teknik maupun non teknis. Penghapusan roya secara elektronik agar dapat melayani kebutuhan masyarakat terhadap Penghapusan roya secara elektronik secara sistem online namun masih memiliki kendala baik eksternal maupun internal. The difference between Roya Elektronik and manual is that the file from the applicant is scanned and registered through the website and immediately corrected by the roya executor, not through the land counter. So that the Notary/PPAT does not have to come to the Land Office because it can be online from the Notary's office. After receiving the land title certificate, it is then given back to the auctioneer. In practice, in rural areas the auction winner has paid off his debt to the bank and received a letter of roya, but the certificate of land rights still contains a barcode record of the imposition of Electronic Mortgage even though the fact is that the land is clear of the burden. Departing from this, the author arises two questions: How is the implementation Elimination of Roya Mortgage Rights Electronically at the Batang Regency Land Office? And what are the Inhibiting and Supporting Factors in the Implementation of the Elimination of Roya Mortgage Electronically at the Land Office of Batang Regency?. The research method that will be used in this paper is a sociological juridical research method. The approach that the author uses in this study is a normative juridical approach. Application files that do not comply with procedures are known from the results of the inspection of the Land Office, if not checked, the HT-el certificate will be issued automatically on the seventh day. Issuance without any inspection from the Land Office if there is a procedural error, it is feared that it will become a problem in the future. Elimination of roya electronically is carried out by the applicant, namely the debtor, attorney or his representative by filling out the application electronically. If it is seen in practice, the Elimination of Roya electronically electronically or online is carried out through PPAT intermediaries at the PPAT office because PPAT has a user name and password when accessing the registration system. in order to be able to serve the needs of the community for the Elimination of roya electronically through an online system but still have obstacles both external and internal
