Abstract

Dalam pelaksanaan pembangunan jalur ganda rel kereta api, tentunya membutuhkan lahan yang cukup besar untuk itu. Ada 2 tanah yang harus dibebaskan, diantaranya tanah yang diklaim oleh PT. KAI dan tanah yang diklaim milik warga (Hak Milik) yang dipengaruhi oleh pembangunan jalur ganda rel kereta api. Namun demikian, dalam pelaksanaan pembangunan jalur ganda rel kereta api lintas Pekalongan-Semarang menimbulkan berbagai macam permasalahan antara lain : Penggantian Kerugian Terhadap Pengadaan Tanah bagi pembangunan jalur ganda rel kereta api, pelaksanaan penggantian kerugian terhadap pengadaan tanah bagi pembangunan jalur ganda rel kereta api, dan kendala-kendala yang dihadapi dalam proses pemberian ganti rugi. Penelitian ini menggunakan teknik yuridis normatif dengan melakukan wawancara secara langsung kepada warga Jalan Noroyono, Kelurahan Bulu Lor, Kecamatan Semarang Utara, Kota Semarang. Hasil yang diperoleh dari penelitian ini yaitu penggantian kerugian akibat pembangunan jalur ganda rel kereta api Di Jalan Noroyono, bahwa penggantian kerugian yang diberikan PT KAI DAOP IV Semarang kepada warga yang rumahnya belum bersertifikat hanya diberikan uang biaya bongkar bangunan sedangkan rumah yang sudah bersertikat diberikan ganti kerugian sebesar Rp.2.250.000/m2, serta kurangnya Tim Pelaksana dalam penertiban lahan membuat proyek pembangunan jalur ganda rel kereta api lintas Pekalongan-Semarang yang awalnya ditargetkan selesai dalam 90 Hari menjadi selesai dalam 9 Bulan. Dari permasalahan di atas dapat disimpulkan, penggantian kerugian pembangunan jalur ganda rel kereta api Di Noroyono cenderung dibedakan antara rumah yang sudah bersertifikat dengan yang belum bersertifikat, dan saat pembangunan jalur ganda rel kereta api mengalami kemunduran dari yang sudah ditargetkan. In the implementation of the construction of a double track railroad, of course, requires a large enough land for it. There are 2 lands that must be acquired, including land claimed by PT. KAI and land claimed to belong to residents (Hak Milik) affected by the construction of a double track railroad. However, in the implementation of the construction of the Pekalongan-Semarang double track railroad crossing, it raises various kinds of problems, including: Compensation for Land Acquisition for the construction of double track railroads, implementation of compensation for land acquisition for the construction of double track railroads, and the obstacles faced in the process of granting compensation. This study uses normative juridical techniques by conducting direct interviews with residents of Jalan Noroyono, Bulu Lor Village, North Semarang District, Semarang City. The results obtained from this study are compensation for losses due to the construction of a double track railroad on Jalan Noroyono, that the compensation given by PT KAI DAOP IV Semarang to residents whose houses have not been certified is only given money for demolition costs while houses that have been certified are given compensation. amounting to Rp.2,250,000/m2, as well as the lack of an Implementing Team in controlling land made the Pekalongan-Semarang double track railway construction project which was originally targeted to be completed in 90 days to be completed in 9 months. From the problems above, it can be concluded that the replacement of disadvantages of the construction of the double track railway In Noroyono tend to be distinguished between houses that have been certified and those that have not been certified, and when the construction of the double track railway has regressed from the target.
