Abstract
Penulis melakukan penelitian ini dilatarbelakangi oleh banyaknya kasus-kasus kejahatan yang menimpa beberapa publik figur akibat perkembangan teknologi yang semakin pesat yaitu cyberbullying atau perundungan dalam media sosial. Dalam penulisan penelitian ini bertujuan untuk mengetahui bagaimana kebijakan hukum pidana terhadap cyberbullying, faktor-faktor dan dampak dari adanya cyberbullying serta upaya penanggulangan terhadap tindak pidana cyberbullying oleh aparat kepolisian. Penelitian ini menggunakan penelitian hukum yuridis sosiologis dengan menggunakan bahan penelitian dari data primer berupa data yang diperoleh dari kuesioner online serta wawancara dan data sekunder berupa Peraturan Perundang-undangan, beberapa buku literatur, jurnal hukum dan tulisan yang berkaitan dengan masalah yang diangkat dalam penelitian ini. Selain itu penulis juga melakukan metode penelitian lapangan dengan melakukan wawancara kepada pihak Kepolisian Subdit V Siber Ditreskrimsus Polda Jateng guna mendapatkan informasi data yang lebih akurat. Hasil penelitian ini dapat disimpulkan bahwa : (1) kebijakan hukum pidana terhadap cyberbullying pada kebijakan penal dengan peraturan perundang-undangan dan kebijakan non-penal dengan pendekatan-pendekatan. (2) faktor-faktor penyebab terjadinya cyberbullying adalah faktor dari dalam diri, faktor dari luar diri, dan faktor lainnya serta dampak yang ditimbulkan dari perilaku cyberbullying terhadap korban, pelaku, dan masyarakat. (3) upaya penanggulangan terhadap tindak pidana cyberbullying oleh aparat kepolisian dengan melakukan upaya pre-emtif, upaya preventif dan upaya represif. The authors of this study were motivated by the many cases of crime that befell some public figures due to the rapid development of technology, namely cyberbullying or bullying in social media. In the writing of this study aims to find out how criminal law policies against cyberbullying,the factors and impacts of cyberbullying and countermeasures against cyberbullying by police officers. This study uses sociological juridical law research using research materials from primary data in the form of data obtained from online questionnaires as well as interviews and secondary data in the form of Laws and Regulations, several literature books, legal journals and writings related to the issues raised in this study. In addition, the author also conducted field research methods by conducting interviews with the Subdit V Siber Ditreskrimsus Polda Jateng Police to get more accurate data information. The results of this study can be concluded that: (1) criminal law policy against cyberbullying on penal policy with laws and non-penal policies with approaches. (2) The factors that cause cyberbullying are factors from within, factors from outside the self, and other factors and the impact of cyberbullying behavior on victims, perpetrators, and society. (3) countermeasures against cyberbullying by police officers by making pre-emtive, preventive and repressive efforts.
