Abstract

Penelitian ini bertujuan untuk menjelaskan: 1) faktor-faktor yang mendorong anak di bawah umur terlibat sebagai pelaku tindak pidana pencurian disertai kekerasan di Wilayah Hukum Kepolisian Resort Kota Besar Semarang; dan 2) peranan Kepolisian Resort Kota Besar Semarang dalam rangka menanggulangi tindak pidana pencurian yang disertai dengan kekerasan yang dilakukan oleh anak di bawah umur. Tipe penelitian yang digunakan dalam penelitian ini adalah yuridis sosiologis, karena penelitian ingin mengkaji kaidah- kaidah, konsep, pandangan masyarakat, doktrin-doktrin hukum yang diperoleh dari bahan hukum sekunder, serta peraturan perundang-undangan yang berlaku, baik yang berkaitan dengan permasalahan yang dibahas yaitu kejahatan pencurian disertai kekerasan, yang dilakukan oleh anak di bawah umur. Hasil penelitian memperlihatkan bahwa: 1) tindak pidana pencurian dengan kekerasan yang dilakukan oleh anak di bawah umur atau bentuk kenakalan anak pada khususnya merupakan perbuatan yang meresahkan masyarakat, karena selain menimbulkan kerugian harta benda juga dapat menghilangkan nyawa seseorang yang tidak bersalah. Pada dasarnya terdapat 2 (dua) faktor utama yang menyebabkan seorang anak di bawah umur melakukan tindak pidana pencurian dengan kekerasan, yang pertama adalah berasal dari diri pelaku sendiri (faktor internal); 2) Peranan Polrestabes Semarang tersebut dalam penanggulangan tindak pidana pencurian dengan kekerasan yang dilakukan adalah melalui operasi rutin dan operasi khusus. Operasi rutin dilakukan secara rutin selama 24 jam sehari sedangkan operasi khusus diadakan bila berdasarkan data yang ada terjadi peningkatan yang tajam baik dari segi kualitas maupun segi kuantitasnya. This study aims to explain: 1) the factors that encourage minors to be involved as perpetrators of criminal acts of theft accompanied by violence in the Legal Area of the Police Resort Kota Besar Semarang; and 2) the role of the Semarang City Police Resort in tackling the crime of theft accompanied by violence committed by minors. The type of research used in this research is sociological juridical, because the research wants to examine the principles, concepts, views of society, legal doctrines obtained from secondary legal materials, as well as applicable laws and regulations, both those relating to the issues discussed. namely the crime of theft accompanied by violence, which is committed by minors. The results of the study show that: 1) the crime of theft with violence committed by minors or forms of child delinquency in particular is an act that disturbs the community, because in addition to causing property losses, it can also eliminate the life of an innocent person. Basically there are 2 (two) main factors that cause a minor to commit a crime of theft with violence, the first is from the perpetrator himself (internal factor); 2) The role of the Semarang Polrestabes in overcoming the crime of theft with violence carried out is through routine operations and special operations. Routine operations are carried out routinely 24 hours a day, while special operations are held if based on available data there is a sharp increase in both quality and quantity.
