Abstract

Penelitian ini bertujuan membahas tentang “Perlindungan Hukum terhadap seseorang yang kehilangan hak pilih dalam pemilu.” Latar belakang penelitian ini adalah sebagai negara demokrasi, Indonesia dalam hal ini hak memilih merupakan hak fundamental warga negara dimana masyarakat sebagai pemegang kedaulatan yang turut berpartisipasi mewujudkan pelaksanaan negara yang demokratis. Sarana yang diberikan untuk menwujudkan kedaulatan rakyat adalah melalui kegiatan pemlihan umum. Pemilihan umum bertujuan untuk menyalurkan aspirasi rakyat dengan memilih wakil rakyat guna membentuk pemerintahan yang demokratis dan memperoleh dukungan dari masyarakat. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normative, yaitu data yang diperoleh berdasarkan peraturan perundang-undangan, serta bahan hukum penelitian yang diperoleh dari studi kepustakaan dan observasi di lapangan. Berdasarkan hasil penelitian terkait perlindungan hukum, dalam pelaksanaannya perlindungan hukum terhadap seseorang yang kehilangan haknya tetap dapat menggunakan hak memilihnya dengan menunjukkan KTP dan datang pada waktu yang telah ditentukan yaitu diatas jam 12.00 WIB. Ketentuan perlindungan hukum sendiri diatur dalam UU Nomor 39 Tahun 1999 yang mengatur tentang Hak Asasi Manusia, yang menjelaskan bahwa setiap warga negara berhak untuk memilih dan dipilih dalam pemilihan umum berdasarkan persamaan hak melalui pemungutan suara yang sesuai dalam ketentuan peraturan perundang-undangan. BSTRACT This study aims to discuss "Legal Protection against someone who loses their right to vote in elections." The background of this research is that as a democratic country, Indonesia in this case the right to vote is a fundamental right of citizens where the community as the holder of sovereignty participates in realizing the implementation of a democratic state. The means provided to realize people's sovereignty is through general election activities. The general election aims to channel the aspirations of the people by electing representatives of the people in order to form a democratic government and gain support from the community. The research method used in this research is normative juridical, namely data obtained based on legislation, as well as legal research materials obtained from literature studies and field observations. Based on the results of research related to legal protection, in the implementation of legal protection for someone who has lost his rights can still use his right to vote by showing an ID card and coming at a predetermined time, which is above 12.00 WIB. The provisions of legal protection itself are regulated in Law Number 39 of 1999 which regulates Human Rights, which explains that every citizen has the right to vote and be elected in general elections based on equal rights through voting in accordance with the provisions of the legislation.
