Abstract

Penelitian ini bertujuan untuk menjelaskan; 1) faktor-faktor yang menjadi penyebab terjadinya kekerasan oleh suporter sepakbola di Kota Semarang; b) perlindungan hukum terhadap korban kekerasan suporter sepakbola di Kota Semarang; dan c) upaya penanggulangan yang dilakukan oleh Polrestabes Semarang terhadap tindak pidana kekerasan oleh suporter sepakbola di Kota Semarang. Tipe penelitian ini adalah yuridis sosiologis. Yuridis sosiologis memandang tindak pidana kekerasan suporter sepakbola berdasarkan pada undang-undang yang berlaku, dan akibat yang ada ataupun unsur yang memberatkan dengan pembuktian untuk membuktikan kebenarannya. Adapun spesifikasi penelitian adalah deskriptif analitis yaitu untuk menggambarkan tentang faktor yang melatarbelakangi terjadinya tindak pidana oleh suporter sepakbola di Wilayah Hukum Kepolisian Resort Kota Besar Semarang, serta upaya penanggulangan yang dilakukan oleh aparat kepolisian terhadap tindakan kekerasan yang dilakukan oleh suporter sepakbola di Kota Semarang. Hasil penelitian memperlihatkan bahwa: a) Faktor-faktor penyebab terjadinya kekerasan suporter sepakbola di wilayah hukum Polrestabes Semarang, yaitu; adanya soliditas kelompok, faktor umur, katarsis sosial, dan fanatisme kedaerahan yang berlebihan’ b) Perlindungan hukum telah diberikan oleh Polrestabes Semarang terhadap korban kekerasan oleh suporter sepakbola di wilayah hukum Polrestabes Sematang. Perlindungan dan jaminan hukum yang diberikan terhadap korban salah satunya berupa digunakannya Undang-Undang Nomor 13 Tahun 2006 tentang Perlindungan Saksi dan Korban dan Undang-Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak, bilamana korban kekerasan suporter sepakbola tadi adalah masih anak-anak. Di sisi lain, Polrestabes Semarang bisa pula memberikan perlindungan hukum berupa fisik saksi dan korban tindak pidana. Polisi bisa melakukan pengawasan keamanan diri saksi dan korban tindak pidana bahkan tidak menutup kemungkinan melakukan penjagaan/pengawalan. Polisi dalam memberikan perlindungan hukum terhadap saksi dan korban sebatas pada tahap penyidikan. Kendala yang dihadapi polisi dalam memberikan perlindungan hukum terhadap saksi dan korban adalah keterbatasan anggaran dana, keterbatasan personil untuk ditugasi memberikan perlindungan hukum; dan c) Upaya penanggulangan yang dilakukan oleh aparat Kepolisian Wilayah Hukum Polrestabes Semarang terhadap tindak pidana kekerasan oleh suporter sepakbola terdapat 2 (dua) upaya pokok penanggulangan, yaitu upaya preventif dan upaya represif. ABSTRACT This study aims to explain; 1) the factors that cause violence by football fans in the city of Semarang; b) legal protection for victims of violence by football fans in the city of Semarang; and c) the prevention efforts carried out by the Semarang Polrestabes against violent crimes by football supporters in the city of Semarang. This type of research is sociological juridical. Sociological juridical views that criminal acts of violence by football supporters are based on applicable laws, and the existing consequences or aggravating elements with evidence to prove the truth. The specification of the research is descriptive analytical, namely to describe the factors behind the occurrence of criminal acts by football supporters in the Legal Area of the Police of the Big City of Semarang, as well as the countermeasures made by the police against acts of violence committed by football supporters in the city of Semarang. The results of the study show that: a) The factors that cause violence by football fans in the jurisdiction of Polrestabes Semarang, namely; the existence of group solidity, age factor, social catharsis, and excessive regional fanaticism' b) Legal protection has been provided by the Semarang Polrestabes to victims of violence by football fans in the Sematang Polrestabes jurisdiction. One of the legal protections and guarantees given to victims is the use of Law Number 13 of 2006 concerning the Protection of Witnesses and Victims and Law Number 23 of 2002 concerning Child Protection, if the victim of violence by football fans is still a child. On the other hand, Semarang Polrestabes can also provide legal protection in the form of physical witnesses and victims of criminal acts. The police can monitor the safety of witnesses and victims of criminal acts and even do not rule out guarding/guarding them. The police in providing legal protection to witnesses and victims are limited to the investigation stage. The obstacles faced by the police in providing legal protection to witnesses and victims are limited budget funds, limited personnel to be assigned to provide legal protection; and c) There are 2 (two) main countermeasures for the prevention of violent crime by football fans, namely preventive efforts and repressive efforts.
