Abstract
Semenjak dirancang sampai disahkannya saat rapat Paripurna Dewan Perwakilan Rakyat Republik Indonesia 5 Oktober 2020, Undang Undang Cipta Kerja banyak menuai kontra dari berbagai pihak. Satu diantara penyebabnya, adanya tafsiran bahwa Undang Undang tersebut mempermudah proses investasi dan usaha, tetapi mengabaikan perlindungan lingkungan hidup. Tulisan ini melihat perizinan lingkungan dalam Undang Undang Cipta kerja serta dampaknya terhadap lingkungan. Undang Undang Cipta Kerja mengintegrasikan Izin Lingkungan ke dalam Perizinan Berusaha yang berbasis pada tingkat resiko yang memberi peringatan dan kewaspadaan terhadap kegiatan khususnya yang memiliki resiko tinggi terhadap kesehatan, keselamatan, lingkungan dan sumber daya. Efek pengintegerasian, apabila ada pelangaran yang dilakukan oleh penerima izin, maka yang akan terkena konsekuensi ialah Perizinan Berusahanya. Komisi IV DPR RI perlu untuk menngawasi agar Undang Undang tersebut dapat diimplementasikan dalam mendukung iklim usaha sekaligus menjaga kualitas lingkungan. Dewan Perwakilan rakyat republik Indonesia juga perlu mendesak pemerintah agar segera membuat peraturan pelaksanaannya. ABSTRACT Since it was drafted until it was ratified at the Plenary Meeting of the House of representatives of there Republic of Indonesiaon October 5, 2020, the Job Creation Law has drawn many contra from various parties. One of there a sonsis that there is an interpretation that the Law facilitates the investment and business process, but ignores environmentalprotection. This paper looks at environmental licensing in the Job Creation Act and itsimpact on the environment. The Job Creation Act integrates Environmental Permits into Business Licensing based on the level of risk that warns and alerts activities, especially those that have high risks to health, safety, environment and resources. The effect of integration, if there is a violation committed by the licensee, the consequence will be the Business Licensing. Commission IV of the DPR RI needs to supervise so that the Law canbe implemented to support the business climate as well as to maintain environmental quality. The House of representatives of the republic of Indonesia also needs to urge thegovernmentto immediately makeimplementing regulations.
