Abstract
Pelanggaran terhadap norma-norma hukum yang berlaku sering terjadi dan kejahatan semakin bertambah. Korupsi yang sering terjadi terutama di lingkungan pejabat negara. Tindak pidana korupsi merupakan perbuatan yang bukan saja dapat merugikan keuangan negara akan tetapi juga dapat menimbulkan kerugiankerugian pada perekonomian rakyat. Barda Nawawi Arief berpendapat bahwa, tindak pidana korupsi merupakan perbuatan yang sangat tercela, terkutuk dan sangat dibenci oleh sebagian besar masyarakat; tidak hanya oleh masyarakat dan bangsa Indonesia tetapi juga oleh masyarakat bangsa-bangsa di dunia. Perumusan masalah dalam penelitian ini adalah 1) Bagaimana penindakan tindak pidana korupsi di dalam kewenangan penyidik kepolisian ? 2) Kendala apakah yang dihadapi dalam penindakan tindak pidana korupsi di dalam kewenangan penyidik kepolisian ? Metode penelitian ini menggunakan tipe penelitian yang digunakan peneliti adalah yuridis empiris. Sumber data yang digunakan adalah sumber data primer dan sumber data sekunder. Data primer diperoleh dari hasil wawancara, data sekunder diperoleh dari studi pustaka. Metode penyajian data dilkukan dengan editing, metode analisis data menggunakan metode analisis deskritif kualitatif. Hasil penelitian ini penindakan tindak pidana korupsi di dalam kewenangan penyidik kepolisian dengan cara melakukan serangkaian penyidikan merupakan tindak lanjut penyelidikan yang sedikit banyak telah menemukan konstruksi peristiwa pidana korupsi yang telah terjadi. Kendala yang dihadapi dalam penindakan tindak pidana korupsi di dalam kewenangan penyidik kepolisian antara lain : Jumlah anggota penyidik reskrim yang terbatas, informasi yang diterima terkait tindak pidana korupsi masih belum jelas dan terperinci, biaya operasional yang belum memenuhi, kurangnya kesadaran hukum masyarakat. Violations of applicable legal norms often occur and crimes are increasing. Corruption often occurs, especially in state officials. Corruption is an act that can not only harm the state's finances but can also cause losses to the people's economy. Barda Nawawi Arief is of the opinion that the criminal act of corruption is a very despicable act, condemned and very hated by most of the people; not only by the people and nation of Indonesia but also by the people of the nations of the world. The formulation of the problem in this study is 1) How is the prosecution of criminal acts of corruption within the authority of police investigators? 2) What are the obstacles faced in the prosecution of criminal acts of corruption within the authority of police investigators? This research method uses The type of research by the researcher is juridical empirical. The data sources used are primary data sources and secondary data sources. Primary data obtained from interviews, secondary data obtained from literature study. The method of presenting the data is by editing, the method of data analysis using the method of qualitative descriptive analysis. The results of this study are that the prosecution of criminal acts of corruption within the authority of police investigators by conducting a series of investigations is a follow-up to the investigation which more or less has found the construction of criminal acts of corruption that have occurred. Constraints faced in taking action against corruption within the authority of police investigators include: Limited number of members of the Criminal Investigation Unit, information received regarding corruption crimes is still unclear and detailed, operational costs that have not been met, lack of public legal awareness.
