Abstract

Salah satu kebutuhan pokok manusia adalah tempat tinggal. Banyak perumahan yang dibuat oleh developer. Semakin banyaknya developer perumahan tentunya semakin memudahkan masyarakat untuk memilih rumah yang sesuai dengan kemampuan finansialnya. Namun, seringkali terdapat kendala terkait Izin Mendirikan Bangunan dalam proses jual beli rumah antara konsumen dan developer, seperti akibat hukum dan tanggung jawab developer akibat perumahan yang dibangun tidak memiliki Izin Mendirikan Bangunan sebagai salah satu contohnya yaitu PT TJP yang telah memasarkan perumahan kepada konsumen namun belum memiliki Izin Mendirikan Bangunan. Jenis penelitian yang penulis gunakan untuk menyusun skripsi ini adalah penelitian hukum normatif atau kepustakaan, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder yang meliputi bahan hukum primer dan bahan hukum sekunder. Berdasarkan hasil penelitian yang dilakukan penulis, atas dasar perbuatan melawan hukum atau wanprestasi developer akibat undang-undang tentang perumahan yang dibangun tanpa Izin Mendirikan Bangunan, developer dapat dipidana dengan kurungan penjara berdasarkan Pasal 8 ayat (1) huruf f dan Pasal 62 Undang- Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Tanggung jawab developer perumahan yang dibangun di atas tanah tanpa Izin Mendirikan Bangunan adalah membayar ganti rugi kepada konsumen berdasarkan Pasal 1243 dan Pasal 1365 KUHPerdata. One of the basic human need is a place to live. Many houses are made by developers. The more housing developers, of course, the easier it is for people to choose a house that suits their financial capabilities. However, there are often obstacles related to Building Permits in the process of buying and selling houses between consumers and developers, such as legal consequences and the developer's responsibility for houses built on land that does not yet exist building permit as one example is PT TJP which has marketed housing to consumers but does not yet have a building permit. The type of research used by the author to compose this thesis is normative legal research or literatur, namely legal research contuted by examining library materials or secondary data which includes primary legal materials and secondary legal materials. Based on the results of research conducted by the author, on the basis of unlawful acts or developer default as a result of the law on housing built on land without a Building Permit, the developer can be sentenced to imprisonment based on Article 8 paragraph (1) letter f and 62 of the Law. Law Number 8 of 1999 about Consumer Protection. The responsibility of the developer of housing built on land without a Building Permit is to pay compensation to consumers based on Article 1243 and Article 1365 of the Civil Code.
