Abstract
Perundungan/Bullying, bukan merupakan suatu tindak pidana baru di tengah masyarakat, Bullying tidak dapat dipandang sebelah mata mengingat dampak dari Bullying paling berbahaya, yaitu dapat menyebabkan seseorang memiliki keinginan untuk bunuh diri. Karenanya perlu perlindungan yang diberikan oleh Hukum supaya tindak pidana Bullying di Indonesia dapat berkurang. Metode penelitain dilakukan melalui pendekatan kualitatif, dengan jenis penelitian Yuridis Normatif. Sumber data yang diperoleh peneliti adalah dari Komisi Perlindungan Anak Indonesia (KPAI), SMA Negeri 1 Semarang dan studi Pustaka. Hasil penelitian menunjukkan bahwa (1) realita tindak pidana Bullying yang didapat melalui Komisi Perlindungan Anak Indonesia (KPAI) penulis mengklarifikasikan beberapa perbuatan yang termasuk dalam kategori Bullying, yaitu anak korban kekerasan di sekolah (Bullying), anak pelaku kekerasan di sekolah (Bullying), anak sebagai korban kekerasan fisik, anak sebagai korban kekerasan psikis, anak pelaku kekerasan fisik, anak pelaku kekerasan psikis. peraturan perundang-undangan di Indonesia yang mengatur untuk melindungi korban tindak pidana Bullying adalah Pasal 76C Undang-Undang Nomor 35 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan anak. Sedangkan perlindungan untuk pelaku dengan mengedepankan diversi dalam upaya penyelesaian tindak pidana Bullying dan mengesampingkan sanksi pidana. (2) rumusan Pasal 76C Undang-Undang Nomor 35 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan anak perlu reformulasi pasal dengan menyebutkan bahwa kekerasan fisik dan kekerasan non fisik termasuk dalam tindak pidana Bullying, atau memasukan penjelasan terhadap pasal 76C Undang-Undang Nomor 35 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan anak, sehinga yang dimaksud kekerasan adalah kekerasan fisik dan kekerasan non fisik. Upaya non penal dalam mengatasi Bullying dapat dilakukan suatu pembuatan program yang dimasukan di dalam kurikulum belajar siswa, dapat berupa mata pelajaran, mini drama, ataupun bentuk pelajaran lain. Dari pembahasan dapat disimpulkan: (1) perlindungan hukum bagi korban yaitu terdapat pada Pasal 76 C Undang-Undang Perlindungan anak, dan bagi pelaku dengan mengedepankan diversi (2) perlu reformasi pasal atau pemberian penjelasan terhadap pasal 76C Undang-Undang Nomor 35 Tahun 2014. Perlu upaya non penal dalam menanggulangi permasalahan Bullying di Indonesia dengan pembentukan program khusus Bullying is not a new crime in society, Bullying cannot be underestimated considering the most dangerous impact of Bullying, which can cause a person to have a desire to commit suicide. Therefore, the protection provided by law is needed so that the crime of bullying in Indonesia can be reduced. The research method is carried out through a qualitative approach, with the type of normative juridical research. Sources of data obtained by researchers are from the Indonesian Child Protection Commission (KPAI), SMA Negeri 1 Semarang and the Library study. The results of the study show that (1) the reality of the crime of bullying obtained through the Indonesian Child Protection Commission (KPAI) the author clarifies several acts that are included in the category of bullying, namely children who are victims of violence at school (Bullying), children who are perpetrators of violence in schools (Bullying), children as victims of physical violence, children as victims of psychological violence, children who are perpetrators of physical violence, children who are perpetrators of psychological violence. The laws and regulations in Indonesia that regulate to protect victims of the crime of bullying are Article 76C of Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection. Meanwhile, protection for perpetrators by prioritizing diversion in an effort to resolve the crime of bullying and overriding criminal sanctions. (2) the formulation of Article 76C of Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection requires article reform by stating that physical violence and non-physical violence are included in the crime of bullying, or include an explanation of article 76C Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection, so that what is meant by violence is physical violence and non-physical violence. Non-penal efforts in overcoming bullying can be done by making a program that is included in the student learning curriculum, it can be in the form of subjects, mini dramas, or other forms of lessons. From the discussion, it can be concluded: (1) legal protection for victims is contained in Article 76C of the Child Protection Act, and for perpetrators by prioritizing diversion (2) it is necessary to reform articles or provide explanations to Article 76C of Law Number 35 of 2014.
