Abstract
Pendaftaran Tanah merupakan persoalan yang sangat penting dalam UUPA, karena pendaftaran tanah merupakan awal dari proses lahirnya sebuah bukti kepemilikan hak atas tanah, maka untuk menunjang hal tersebut bagi masyarakat Indonesia, Pemerintah membentuk program Pendaftaran Tanah SIstematis Lengkap yang diatur dalam Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 6 tahun 2018 tentang Pendaftaran Tanah Sistematis Lengkap, Permasalahan yang muncul adalah bahwa di diketahui pada Desa Bango, Kec. Demak, Kab. Demak banyak masyarakat yang tanahnya masih berstatus Letter C yang masih belum didaftarkan menjadi Sertifikat Hak Milik, yang mana diketahui bahwa dalam buku letter C itu sangatlah tidak lengkap dan cara pencatatannya tidak secara teliti dan hati-hati sehingga akan banyak terjadi permasalahan yang timbul nantinya karena kurang lengkapnya data yang akurat dalam buku letter C tersebut. Metode Penelitian Jenis / Tipe penelitian yang akan digunakan pada penelitian ini adalah yuridis sosiologis, yaitu suatu metode pendekatan yang tidak hanya ditinjau dari kaidah-kaidah hukum saja, tetapi juga meninjau keadaan yang timbul dalam masyarakat tentang pelaksanaan PTSL pada Desa Bango, Kec. Demak Kab. Demak dikaitkan kaidah- kaidah hukum tersebut. Hasil Penelitian bahwa kinerja Kantor Pertanahan Kabupaten Demak, dalam Penerbitan Sertifikat Hak Milik Atas Tanah dari Letter C melalui Program Tanah Sistematis Lengkap ( PTSL ) termasuk dalam kategori baik dan sudah sudah dilaksanakan sesuai dengan peraturan perundang - undangan yang berlaku. Hambatan- Hambatan Internal dan Eksternal pelaksanaan pendaftaran Sertifikat Hak Milik dari Letter C pada Kantor Pertanahan Kabupaten Demak adalah Hambatan Internal kurangnya sumber daya manusia. Dan Hambatan Eksternal yaitu Masih Kurangnya Pemahaman Masyarakat terhadap prosedur pelaksanaan pendaftaran tanah untuk pertama kali. Land Registration is a very important issue in the UUPA, because land registration is the beginning of the process of the birth of a proof of ownership of land rights, so to support this for the people of Indonesia, the Government established a Complete Systematic Land Registration program which is regulated in the Regulation of the Minister of Agrarian And Spatial Planning / Head of the National Land Agency Number 6 of 2018 concerning Lengka Systematic Land Registration, The problem that arises is that in Bango Village, Demak District, Demak Regency, there are many people whose land still has the status of Letter C which is still not registered as a Certificate of Property Rights, which is known that in the letter C book it is very incomplete and the way of recording it is not carefully and carefully so that there will be many problems that arise due to the incompleteness of accurate data in the letter C book. Research Methods The type / type of research that will be used in this study is sociological juridical, which is an approach method that is not only reviewed from the rules of law, but also reviews the situation that arises in the community regarding the implementation of PTSL in Bango Village, Demak District, Demak Regency, related to these legal rules. The results of the research show that the performance of the Demak Regency Land Office, in the Issuance of Land Title Certificates from Letter C through the Complete Systematic Land Program (PTSL) is included in the good category and has been implemented in accordance with applicable laws and regulations. Internal and External Obstacles to the implementation of the registration of The Certificate of Title from Letter C at the Demak District Land Office are internal Obstacles to the lack of human resources. And external obstacles are still the lack of public understanding of the procedure for implementing land registration for the first time.
