Abstract

Penyidikan merupakan serangkaian tindakan penyidik dalam hal dan menurut cara yang diatur dalam undang-undang untuk mencari serta mnegumpulkan bukti-bukti dengan bukti itu membuat terang tindak pidana yanng terjadi. Dalam melakukan tugas penyidikan, penyidik diberi kewenangan untuk melakukan tindakan yang memungkinkan diselesaikannya proses penyidikan. Metode pendekatan yang digunakan dalam penelitian ini adalah penelitian hukum yang yuridis-normatif yaitu penelitian hukum terhadap data kepustakaan yang terkait dengan penyidikan terhadap di Polrestabes Semarang. Proses penyidikan dalam penanganan penyalahgunaan psikotropika yang bersumber dari masyarakat, selanjutnya menginventarisir daftar pencarian orang (DPO) melalui hasil berita acara pemeriksaan yang bersumber dari informasi, selanjutnya mmbuat laporan informasi yang dituangkan dalam format yang telah ditetapkan sesuai dengan aturan yang ada. Selanjutnya informasi dibuat oleh penyidik dalam hal kepolisian. Pimpinan mengeluarkan surat perintah tugas dan surat perintah penyelidikan dan atas dasar surat perintah tugas itu dan surat perintah penyidikan satres psikotropika membuat rencana penyelidikan. Dalam melakukan tugas penyidikan, penyidik diberi kewenangan untuk melakukan tindakan yang memungkinkan diselesaikannya proses penyidikan. Dalam proses penyidikan,dipastikan penyidik tidak akan lepas dari faktor penghambatdan faktor pendukung yang masing-masing memiliki unsur internaldan eksternal. Beberapa kendala yang muncul saat penyidik polri menangai tindak pidana psikotropika adalah Kendala struktural, membutuhkan lagi tambahan polisi yang berkualitas, masih lemahnya penegakan hukum, oknum aparat yang mudah disuap, diperdaya maupun diajak kerjasama dengan alasan masih rendahnya kesejahteraan polisi menjadikan kualitas diskresi rendah. Investigation is a series of investigative actions in terms of and according to the manner regulated in the law to seek and collect evidence with evidence that makes it clear that the crime that occurred. In carrying out investigative duties, investigators are given the authority to take actions that enable the investigation process to be completed. The approach method used in this study is legal research that is normative-juridical, namely legal research on library data related to investigations at Polrestabes Semarang. The investigative process in dealing with psychotropic abuse originating from the community, then taking inventory of wanted persons (DPO) lists through the results of the inspection report sourced from information, then preparing an information report which is set forth in a predetermined format in accordance with existing regulations. Further information is made by investigators in the case of the police. The leadership issues an assignment order and an investigation order and on the basis of the assignment order and the psychotropic satres investigation order makes an investigation plan. In carrying out investigative duties, investigators are given the authority to take actions that enable the investigation process to be completed. In the investigation process, it is certain that investigators will not be separated from inhibiting factors and supporting factors, each of which has internal and external elements. Some of the obstacles that arise when police investigators deal with psychotropic crimes are structural constraints, needing additional quality police officers, weak law enforcement, officers who are easily bribed, tricked or co-opted on the grounds that low police welfare results in low quality discretion.
