Abstract

Kemajuan teknologi menyebabkan banyak sekali pergeseran akan realita kehidupan dari yang semula nyata menjadi dapat dengan mudah dilakukan dengan alat elektronik atau yang dapat disebut dengan dunia maya. Hal ini tentunya dapat menjauhkan manusia dari kehidupan sosial bermasyarakat. Tentunya hal itu akan berdampak buruk, dampak buruk tersebut tanpa manusia sadari atau tidak dapat membahayakan karena mengganggu pola pikir masyarakat. Salah satu jenis kejahatan yang berkembang sangat pesat saat ini dan hampir menjadi hal wajar dalam lapisan masyarakat adalah kejahatan cyberporn seperti kejahatan pornografi internet. Tindak pidana ini sering terjadi kepada korban pornografi yang balas dendam banyak sekali alasan dari adanya penyebaran video / foto pornografi. Dengan demikian perlindungan terhadap korban penyebaran foto dan video pornografi perlu untuk dilakukan agar dapat terus meminimalisir adanya penyebaran tersebut dan jangan sampai menjadi budaya yang akan dirasa wajar.. Penelitian ini bertujuan untuk menjelaskan dan menggambarkan mengenai pembuktian hakim dalam putusannya dan perlindungan hukum bagi korban penyebaran foto dan video pornografi melalui jejaring sosial berdasarkan Putusan Pengadilan Nomor 652/PID.SUS/2020/PN.SMG. Penelitian ini menggunakan jenis penelitian yuridis normatif yaitu dengan metode penelitian yang berdasarkan norma hukum dan peraturan perundang- udangan. Adapun Perumusan masalah dalam penelitian ini adalah : (1) Bagaimana pembuktian hakim dalam menentukan bersalah telah menyebarkan foto dan video pornografi pada Putusan Nomor 652/PID.SUS/2020/PN.SMG? (2) Bagaimana perlindungan hukum bagi korban penyebran foto dan video pornografi pada Putusan Nomor 652/PID.SUS/2020/PN.SMG?. Hasil Penelitian ini menujukan bahwa system pembuktian di Indonesia menggunakan system pembuktian berdasarkan Undang-Undang secara negative yang dimana pembuktian harus disarkan pada Undang-Undang Pasal 183 KUHAP. Perlindungan hukum terhadap korban diberikan dengan cara memberikan perlindungan hukum represif, yaitu dengan pidana penjara bagi terdakwa. Pada kasus penyebaran foto dan video pornografi melalui jejaring sosial pada putusan 652/PID.SUS/2020/PN.SMG menggunakan pasal Pasal 45 ayat (1) Juncto Pasal 27 ayat (1) Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektonik. Advances in technology have caused many shifts in the reality of life from what was originally real to what can be easily done with electronic devices or what can be called virtual worlds. This of course can distance us from social life in society. Of course it will have a bad impact, the bad impact without us knowing it or it can't be dangerous because it disturbs people's mindset. One type of crime that is developing very rapidly at this time and has almost become a normal thing in society is cyberporn crimes such as internet pornography crimes. This crime often happens to victims of pornography who take revenge for many reasons from the spread of pornographic videos/photos. Thus protection for victims of the spread of pornographic photos and videos needs to be done in order to continue to minimize the spread and not let it become a culture that will be considered normal. This study aims to explain and describe the evidence of judges in their decisions and legal protection for victims of photo distribution and pornographic videos via social networks based on Court Decision Number 652/PID.SUS/2020/PN.SMG. This research uses normative juridical research, namely research methods based on legal norms and statutory regulations. The formulation of the problems in this research are: (1) How is the judge proving guilty in distributing pornographic photos and videos in Decision Number 652/PID.SUS/2020/PN.SMG? (2) What is the legal protection for victims of distributing pornographic photos and videos in Decision Number 652/PID.SUS/2020/PN.SMG? The results of this study indicate that the proof system in Indonesia uses a system of evidence based on the law in a negative way, where proof must be based on the Law of Article 183 of the Criminal Procedure Code. Legal protection for victims is provided by providing repressive legal protection, namely by imprisonment for the defendant. In the case of spreading pornographic photos and videos via social networks, the decision 652/PID.SUS/2020/PN.SMG uses Article 45 paragraph (1) Juncto Article 27 paragraph (1) of Law Number 19 of 2016 concerning Amendments to the Law Law Number 11 of 2008 concerning Information and Electronic Transactions.
