Abstract

Penelitian ini bertujuan untuk membahas permasalahan Perlindungan Hukum Ketenagakerjaan Bagi Tenaga Kerja/ Buruh Apabila Terjadi (PHK) Sepihak. Latar belakang penelitian ini adalahPemutusan Hubungan Kerja (PHK) atas inisiatif pihak pengusaha merupakan suatu hal yang sangat ditakuti oleh Pekerja/Buruh. Namun setelah PHK terjadi masih terdapat pihak perusahaan yang tidak memenuhi hak-hak pekerjanya.Penelitian ini memiliki rumusan masalah yaitu Bagaimana bentuk perlindungan hukum terhadap tenaga kerja yang mengalami pemutusan hubungan kerja secara sepihak dan Bagaimanakah analisa penyelesaian sengketa pada Kasus Pemutusan Hubungan Kerja(PHK) sepihak. Tujuan penelitian ini adalah untuk mengetahui bentuk perlindungan hukum terhadap tenaga kerja yang mengalami pemutusan hubungan kerja secara sepihak dan untuk mengetahui analisa penyelesaian sengketa pada Kasus Pemutusan Hubungan Kerja (PHK) sepihak. Metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif yang disajikan secara deskriptif analisis. Teknik Pengumpulan data menggunakan metode kepustakaan. Penelitian ini menggunakan metode analisis kualitatif. Hasil penelitian ini menunjukkan bahwa: Perlindungan hukum bagi tenaga kerja yang terkena PHK secara sepihak meliputi perindungan ekonomis, perlindungan sosial, dan perlindungan teknis. Penyelesaian kasus PHK sepihak harus melalui instansi yang mampu menyelesaikan permasalahan tersebut secara netral, dalam kasus ini penyelesaian pertama kali diajukan kepada Disnakertrans, lalu tidak ada titik terang kasus ini, maka dibawa ke Pengadilan Negeri Semarang dalam upaya penyelesaian terbaik.Saran yang diberikan dalam penelitian ini adalah: Pengusaha sebisa mungkin harus berupaya mengindari Pemutusan Hubungan Kerja (PHK) terhadap karyawannya dan apabila terjadi perselisihan, permasalahan maupun konflik, penyelesaian sengketa secara musyawarah seharusnya lebih diutamakan, serta kedua belah pihak harus saling menghargai satu sama lain mengenai penyelesaian perkara diluar pengadilansekalipun. This study aims to discuss the problem labor law protection for workers/laborers in case of unilateral dismissal.The background of this researchTermination of employment (PHK) at the initiative of the employer is something that is very feared by workers / laborers. However, after layoffs occurred, there were still companies that did not fulfill their workers' rights. This research is entitled This research has a problem formulation, namely how to form legal protection for workers who experience unilateral termination of employment and how to analyze dispute resolution in cases of unilateral termination of employment (PHK). The purpose of this study is to determine the form of legal protection for workers who experience unilateral termination of employment and to determine the analysis of dispute resolution in cases of unilateral termination of employment (PHK).The approach method used in this research is a normative juridical approach which is presented in a descriptive analysis. The data collection technique uses the library method. This study uses a qualitative analysis method. The results of this study indicate that: Legal protection for workers who are unilaterally laid off includes economic protection, social protection, and technical protection. Settlement of cases of unilateral dismissal must be through an agency that is able to resolve the problem neutrally, in this case the settlement was first submitted to the Manpower and Transmigration Office, then there was no clear point in this case, so it was brought to the Semarang District Court in the best possible resolution. The suggestions given in this study are: Employers should try to avoid layoffs of their employees as much as possible and if there is a dispute, problem or conflict, deliberative dispute resolution should be prioritized, and both parties must respect each other regarding settlement of cases outside the courtthough.
