Abstract
Penelitian ini akan membahas tentang peralihan hak sertifikat sebagai dasar hukum seseorang memiliki dan/atau menguasai suatu bidang tanah baik itu hanya tanah pekarangan atau berserta bangunan yang berdiri diatasnya, hal tersebut telah diatur dengan Undang-Undang Nomor 5 Tahun 1960 tentang Pokok-Pokok Agraria yang di dalam mekanismenya diatur pula di dalam Peraturan Pemerintah Nomor 24 tahun 1997 tentang Pendaftaran Tanah, namun dalam prakternya sering di jumpai kesalahan atau kesalahan dengan di sengaja oleh pejabat yang berwenang dalam penerbitan keputusan sertifikat hak atas tanah. Hal ini dapat kita jumpai dalam salah satu perkara Tata Usaha Negara tentang sengketa peralihan hak atas tanah yaitu perkara Nomor 23/G/2020/PTUN.SMG yang mana dalam sengketa perkara tersebut seseorang yang bernama Sumiyatun (Mbah Tun) terlibat sengketa dengan Badan Pertanahan Nasional Kabupaten Demak. Hal ini disebabkan karena pada tahun 2019 Badan Pertanahan Nasional Kabupaten Demak melakukan perlalihan hak terhadap Sertifikat Hak Milik No.11 tahun 1978 atas nama Sumiyatun, terletak di desa Balerejo, Kecamatan Demak, Kabupaten Demak, beralih atas nama Dedy Setyawan Haryanto berdasarkan risalah lelang Nomor.172/2011 yang di terbitkan oleh KPKNL Semarang Penelitian ini bertujuan untuk mengetahui bagaimana tinjauan yuridis Terhadap Pembatalan Sertifikat Hak Atas Tanah Berdasarkan Putusan Perkara Nomor.23/G/2020/PTUN.SMG. Bentuk penelitian ini adalah penelitian Normative yaitu dengan teknik pengumpulan data secara library research (kepustakaan). Data dilengkapi dengan data primer yaitu dapi putusan perkara Nomor. 23/G/2020/PTUN.SMG serta data sekunder seperti peraturan perundang-undangan ,karya ilmiyah serta data tersier menggunakan kamus bahasa Indonesia dan dioleh dengan metode analisis kualitatif secara deduktif. This study will discuss the transfer of certificate rights as the legal basis for a person to own and/or control a plot of land, whether it is only a plot of land or along with the building that stands on it, this has been regulated by Law Number 5 of 1960 concerning Agrarian Principles which the mechanism is also regulated in Government Regulation Number 24 of 1997 concerning Land Registration, but in practice it is often found that errors or mistakes are intentionally made by authorized officials in the issuance of decisions on land rights certificates. We can find this in one of the State Administration cases concerning the dispute over the transfer of land rights, namely case Number 23/G/2020/PTUN. SMG, in which a person named Sumiyatun (Mbah Tun) was involved in a dispute with the National Land Agency. Demak Regency. This is because in 2019 the National Land Agency of Demak Regency transferred the rights to Property Rights Certificate No. 11 of 1978 on behalf of Sumiyatun, located in Balerejo village, Demak District, Demak Regency, transferred to Dedy Setyawan Haryanto based on the minutes of auction Number. 172/2011 published by KPKNL Semarang This study aims to find out how the juridical review of Cancellation of Land Rights Certificates Based on Case Decision Number 23/G/2020/PTUN.SMG. The form of this research is normative research with data collection techniques by library research (library). The data is equipped with primary data, namely the case decision number. 23/G/2020/PTUN.SMG as well as secondary data such as laws and regulations, scientific works and tertiary data using an Indonesian dictionary and obtained by deductive qualitative analysis methods.
